However, the landlord may not terminate the tenancy, to rent under the lease, by giving rent notice for more than forty (40) days prior to the end of the rental term, in which case the landlord shall not recover for damages resulting from a rent late charge or a rent abatement, unless such charges are imposed for the purpose of forcing the renter to remain in the dwelling unit after the end of the rental term, in which event such charges shall be in addition to any rent and late charge otherwise allowed pursuant to this section. The landlord's right to recover for damages in this circumstance shall be limited to the amount of actual damages suffered by the landlord, and no other remedy shall be available in addition to damages provided for in this section. Nothing contained herein shall prevent the landlord from recovering damages in a subsequent action against the renter for nonpayment of the rent due under the lease. The term “dwelling unit” in this case means any structure or portion thereof which has a basement, crawl space or elevator and sleeps one or more families of four and no more than ten (10) persons. The term “landlord” shall not include any entity of which the landlord is a majority owner who has only one (1) party to a lease agreement of ten (10) or less controlling the lease, and such entity would not own or be controlled by the family which occupies the dwelling unit with the right of first refusal. The rent for the dwelling unit leased hereunder shall start on the day the lease is signed and not later than five (5) days before the expiration of the original term. The original term of the agreement is in effect and shall remain in effect until any future termination of the lease in accordance with Paragraph IV and the provisions of this section.
